Terms of Service

1. Agreement and eligibility

These Terms govern streamsafe.io, the StreamSafe desktop application, and associated account and subscription services (the Service). “StreamSafe,” “we,” and “us” refer to the operator of the Service. References to protected parties below include StreamSafe and its creators, developers, contributors, contractors, and service providers, to the extent they are legally entitled to those protections. These descriptions do not represent that StreamSafe is an incorporated entity.

You must be at least 18 and legally able to enter this agreement. By accepting these Terms when using the Service, you agree to them. If you act for an organization, you represent that you can bind it. If you do not agree, do not use the Service.

2. What StreamSafe does and its limits

StreamSafe is a local video delay and rebroadcast tool. It is not a content moderation guarantee, legal compliance service, insurance product, backup service, or emergency system. Buffering, dumping, intermissions, overlays, and destination delivery can fail, behave unexpectedly, or be unavailable. Material already transmitted cannot be recalled, and a dump may not remove everything you intended.

You are responsible for your content, permissions, privacy obligations, platform rules, stream keys, equipment, network, configuration, and decisions to start or continue a broadcast. Test your setup before each broadcast and independently monitor your output. Do not rely on StreamSafe where a failure could cause injury or other serious harm. No feature guarantees prevention of accidental disclosure, copyright claims, platform penalties, or other consequences of broadcasting.

3. Accounts and permitted use

An account is required for Free and Pro. Keep credentials secure, provide accurate information, and notify us of suspected unauthorized access. Social login providers have their own terms. You receive a limited, nonexclusive, nontransferable right to use the Service for lawful purposes while complying with these Terms and your plan.

Do not bypass license checks, interfere with the Service, distribute malware, access another person’s account, or use the Service to violate rights or applicable law. Rights granted by open-source component licenses remain governed by those licenses; these Terms do not override them. You retain rights in your video and other content.

4. Free and paid plans; recurring billing

Free currently allows one dump per broadcast with StreamSafe branding. Pro allows unlimited dumps and removes StreamSafe branding while your subscription is active. Quality controls, multiple destinations, and other streaming tools are available on both plans. A subscription buys access to those features, not a guaranteed result or a perpetual software license. Internet access and valid account and license checks are required.

Pro is billed monthly at the price and currency shown in checkout, currently US$4.99 per month before any applicable taxes or disclosed adjustments. By separately authorizing a recurring subscription at checkout, you authorize charges each billing period until cancellation. Any promotion or trial follows its disclosed terms. We will provide notice of price changes as required by law before they apply to a renewal.

Manage or cancel recurring billing through Account → Billing history & cancellation. Cancellation stops future renewals and ordinarily leaves paid access available through the paid period shown in your account. Uninstalling the application or disconnecting a social login does not cancel billing. Except where required by law or expressly offered by us, payments are nonrefundable and unused portions are not prorated. This does not remove statutory cancellation, refund, or remedy rights. Contact us if billing controls are unavailable.

5. Updates, availability, and third parties

We may update the Service, change compatible integrations, or suspend access for security, abuse, nonpayment, or legal reasons. We may discontinue features or the Service, subject to applicable notice, refund, and other mandatory obligations. No particular support response time, uptime, compatibility, retention period for local video, or future feature is promised.

AWS, Stripe, Discord, streaming platforms, and sign-in providers operate independently. Their availability, decisions, policies, and charges may affect your use. Their names or logos do not imply endorsement. We do not control their services.

6. AS-IS service and disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. STREAMSAFE AND THE PROTECTED PARTIES DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, COMPATIBLE WITH YOUR SETUP, OR ABLE TO PREVENT AN UNWANTED BROADCAST. PAYMENT DOES NOT CREATE ANY SUCH WARRANTY. NO GENERAL DESCRIPTION OR INFORMAL SUPPORT COMMUNICATION CREATES A GUARANTEE. WARRANTIES AND REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED REMAIN IN EFFECT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMSAFE AND THE PROTECTED PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OPPORTUNITIES, GOODWILL, CONTENT, OR DATA ARISING FROM THE SERVICE. THIS INCLUDES CLAIMS INVOLVING MALFUNCTIONS, FAILED DUMPS, DELAY ERRORS, OUTAGES, UNINTENDED DISCLOSURES, STREAM INTERRUPTIONS, OR THIRD-PARTY PLATFORM ACTIONS, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF STREAMSAFE AND THE PROTECTED PARTIES FOR CLAIMS ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID STREAMSAFE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the legal theory, including contract or negligence, only where enforceable. They do not exclude fraud, willful misconduct, gross negligence, liability for death or personal injury where exclusion is prohibited, or any other liability or consumer remedy that applicable law does not permit us to limit. Nothing in these Terms prevents complaints to regulators or the exercise of nonwaivable legal rights.

8. Third-party claims

To the extent permitted by law, you agree to indemnify StreamSafe and the protected parties against third-party claims and reasonable related costs caused by your unlawful content, infringement of another person’s rights, or material breach of these Terms. This obligation does not apply to the extent a claim is caused by our own breach, negligence, or misconduct. We will give reasonable notice of a claim and reasonably cooperate; no settlement may impose an admission or nonfinancial obligation on you without your consent.

9. Governing law, changes, and contact

Ohio law governs these Terms, excluding its conflict-of-law rules, except that mandatory protections in your place of residence continue to apply. These Terms do not impose mandatory arbitration, a class-action waiver, or a restriction on a court or regulator you are legally entitled to use.

We may revise these Terms prospectively and will give reasonable notice of material changes through the Service or email, obtaining renewed agreement where required. A revision will not retroactively change an accrued dispute. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Provisions intended to survive termination, including applicable liability limits, survive. For questions or notices, use the contact below.
